1806, Oct 15 - Deed: Benjamin Wright to Abraham Staats, 200 Acres, Mill Creek

This Indenture made this 15th day of October in the year of our Lord One thousand eight hundred and six Between Benjamin Wright of Greene County and State of Pennsylvania of the one part and Abraham Staats of Mason County and State of Virginia of the other part Witnesseth That the said Benjamin Wright for and in Consideration of the sum of five hundred dollars To him in hand paid hath Bargained and sold and by these present doth grant Bargain and sell and convey to the said Abraham Staats a certain tract or parcel of land lying and being situate in Mason County State of Virginia on Mill Creek a branch of the Ohio River Containing Two hundred Acres being part of a tract of Nine hundred and sixty seven Acres of Land granted by the Commonwealth of Virginia unto Sarah Provance by patent bearing date the tenth day of November One Thousand Seven hundred and Eighty four being laid of on the upper end of s,d tract of adjoining Lands of Robert Rutherford and Bounded as followeth

Beginning at a Hickory and Beech Corner to the Virginia Survey and runing thence S 45 W 248 poles Crossing Mill Creek and a branch thereof to two black oaks corner to the same

Thence N 45 W 129 poles to a hiicory

Thence N 45 E 248 poles to a small Beech

Thence S 45 E 129 poles Beginning

Containing Two hundred Acres more or less with its appurtenances To Have and To Hold the said described tract tract of Land to the said Abraham Staats his heirs Executors and Adminstrators and assigns with its appurtenances peaceably to hold use Occupy and may with out the least trouble hindrance or interruption of him of him the said Benjamin Wright his Heirs or assigns or any person or persons whatsoever lawfully claiming the said tract of land Lastly the said Benjamin Wright and Sarah his wife and their heirs the said land and appurtenances unto him the said Abraham Staats his heirs and assigns against them the said Benjamin Wright & Sarah his wife their Heirs and administrators doth warrant and for ever defend. In Witness whereof they have hereunto set their hands and seals the day and year first above written.

Greene County Test, Commonwealth of Pennsylvania

Personally appeared before me the subsciber One of the Commonwealths Justices of the peace in and for the aforesaid County Benjamin Wright and Sarah his wife and acknowledged the above Indenture to be their Act & voluntary Deed for the use thereon mentioned and desired that the same should be admitted to record as such Sarah The wife being privily examined as the law directs Given under my hand and seal this fifth day of November A. D. 1806.

I John Bowman Prothonotary of the Court of Common Pleas for the said County do certify that Jacob Black Esquire before whom the within Indenture from Benjamin Wright and Sarah his wife to Abraham Staats was acknowledged is one of the Justices of the peace in and for the said County duly appointed and Commissioned as such and full faith and credit is due and ought to be given to his Individual acts as well in Courts of Justice as there acct. In testimony whereof I have here unto set my hand and affixed the seal of the said County this fifth day of November in the year of Our Lord one thousand eight hundred & six.

At a Court held for Mason County the 6th day of Oct.r 1807

This deed of conveyance from Benjamin Wright and Sarah his wife to Abraham Staats was presented in Court the acknowledgement whereof having been certified by Jacob Black one of the Com.ths Justices of the peace for Greene County State of Pennsylvania attested by John Bowman Prothonotary of said County under the seal of the County which this Court think suff.t proof. The same is ordered to record.

Footnotes:

1) In the 1890s, when the railroad came to the community that grew around Abraham Staats farm, which is still owned by his descendants today, the establishment of a post office and whistle stop in the community, compelled the residents to select a name for their community by lottery. The residents chose the name of Evans, WV for their post office and whistle stop.
